Terms and Conditions

The following terms and conditions apply to the Roche Diabetes Care South Africa Proprietary Limited (“Roche Diabetes Care”) NOD Educational course. Register for the NOD course on www.rdiabetescare.com/NODonline and follow the steps provided. After registering for the course, access the NOD online platform by following the instruction guide provided and setting up a personal profile on the NOD platform. The NOD Educational course is intended and available for healthcare professionals (HCP’s) residing in South Africa, Nigeria, Tanzania and Kenya only.

1. Status of Terms and Conditions

1.1. Your purchase and registration to the NOD Educational course constitutes your binding acceptance of these Terms and Conditions on behalf of yourself and/ or any person with whom you may purchase the voucher on behalf of (if not for yourself).

1.2. Any violation or attempt to violate any of these Terms and Conditions will result in the immediate cessation of the registration to the NOD Educational platform, even if the purchased access duration thereof has not been fulfilled.

2. Organiser

The Organiser (and promoter) is Roche Diabetes Care South Africa (Pty) Ltd.

3. Who may register for the NOD Educational Course

Any HCP who is interested in furthering their diabetes and coaching knowledge through an online diabetes education course.

3.1. The NOD Educational course is available to residents of the Republic of South Africa,
Nigeria, Tanzania and Kenya, aged 18 years and older who are in possession of a valid identity document or valid passport (“the Purchaser”).

3.2. Purchaser’s can either register for one or more of the following courses:

3.2.1. Basics of Diabetes Management only,
3.2.2. Health Coaching only or
3.2.3. Basics of Diabetes Management and Health Coaching.

3.3. Purchaser’s may register for the NOD educational course as many times as is needed or required.

4. Duration of NOD Educational course

4.1. Upon purchasing and registration, the purchaser has six months of unlimited access to the NOD Educational platform to complete the course/s registered for.

4.2. In the six months, the purchaser is expected to complete the course/s as well as the relevant assessments in order to have successful completion thereof.

4.3. Once the six months have lapsed, from date of first access, the purchaser will no longer have access to the NOD Educational Platform, regardless of whether the final assessment has been taken or not. Purchaser’s are expected to complete the course and assessment within the six months.

5. Completion and Accreditation of NOD Educational course

5.1. A certificate of completion and relevant accreditation, if available, will be issued once the minimum pass requirement is met.

5.2. The minimum pass requirement is ≥70% and is required to be achieved on all the assessments for the course/s registered for. The assessments can be taken numerous times in order to achieve the pass requirement of ≥70%.

5.3. If the course was not completed successfully within this six month period, the purchaser will need to repurchase and re register for the course/s.

5.4. Formal accreditation for continuing education units is country specific.

5.4.1. South Africa

5.4.1.1. The Basics of Diabetes Management only course has been accredited for 12 continuing education units (CEU) (University of Pretoria, Faculty of Health Sciences). Units will be issued upon successful completion (≥70% achieved on the assessments) within the six month registration time frame. There are four modules accruing three continuing education units each.

5.4.1.2. The Health Coaching only course has been accredited for three CEU’s (University of Pretoria, Faculty of Health Sciences). Units will be issued upon successful completion (≥70% achieved on the assessments) within the six month registration time frame. There is one module with three CEU’s.

5.4.1.3. The Basics of Diabetes Management and Health Coaching course has been accredited for 15 CEU’s (University of Pretoria, Faculty of Health Sciences). Units will be issued upon successful completion (≥70% achieved on the assessments) within the six month registration time frame. There are five modules accruing three CEU’s each.

5.4.2. Nigeria

Country-specific continuing education units have not been accredited for health professionals residing in Nigeria. The purchaser will receive a certificate of completion as well as South Africa accredited CEU points, dependent on course/s registered for as well as successful completion achieved of ≥70% on assessments. CEU breakdown shown in 5.4.1.

5.4.3. Tanzania

Country-specific continuing education units have not been accredited for health professionals residing in Tanzania. The purchaser will receive a certificate of completion as well as South Africa accredited CEU points, dependent on course/s registered for as well as successful completion achieved of ≥70% on assessments. CEU breakdown shown in 5.4.1.

5.4.4. Kenya

Country-specific continuing education units have not been accredited for health professionals residing in Kenya. The purchaser will receive a certificate of completion as well as South Africa accredited CEU points, dependent on course/s registered for as well as successful completion achieved of ≥70% on assessments. CEU breakdown shown in 5.4.1.

6. Course Price

6.1. The price of each course is found at www.rdiabetescare.com/NODonline.

6.2. A volume based pricing is available to any interested party. A 10% discount will be applied on the purchase of 10 or more vouchers and a 20% discount on 20 or more vouchers. The interested party should contact URUP Connect directly at orders@southafrica.rdiabetescare.com to request an invoice that applies the above discount for direct payment and processing. 

6.3. Purchase price is country specific. The Purchaser should select the country theyreside in (South Africa, Nigeria, Kenya and Tanzania).

6.4. The Organiser reserves the right to change the price at any time.

6.5. The terms and conditions for the payment gate are separate to the above and the Organiser is not liable or responsible for any issues resulting thereof.

7. How to register and access the NOD Educational Course

7.1. The Purchaser must go to www.rdiabetescare.com/NODonline and register by selecting the relevant country as well as the relevant payment option on the purchasing site.

7.2. Upon completing the purchasing step above, The Purchaser will receive an email with a PDF attachment explaining how to access the NOD Educational platform.

7.3. The NOD Educational platform can be accessed at any time from a computer or mobile device. Internet is required to access the course/s.

7.4. Once the six month period has lapsed, access to the NOD Educational platform will no longer be available unless another voucher is purchased and the same registration steps above are followed.

8. Disclosure of personal information

Upon registration and throughout the access period of the NOD Educational Platform, the Purchasers’ personal information including name, surname, contact information and healthcare professional registration number will be collected and processed for the intention of creating a NOD platform access profile and to issue a completion/ accreditation certificate. This information will be shared with the Organiser to identify and analyse the number of subscriptions received from the country, courses completed, vouchers redeemed vs paid subscriptions, course completion duration, course accreditation and certification as well as for marketing and communication. Processing of your personal information shall be in accordance with the Protection of Personal Information Act and as per Roche privacy policy available at https://www.rochediabetescaremea.com/en/south-africa-privacy-policy-paia-manual

9. Termination or cancellation of NOD Educational Course

9.1. The Organiser reserves the right to discontinue the NOD Educational course at any time. The Purchaser will be notified and a refund will be made available for the course purchased.

9.2. Once purchased, the six-month registration to the course is non-refundable.

10. Governing law

The NOD Educational Course is governed by the laws of the Republic of South Africa and is subject to the exclusive jurisdiction of the South African courts.

11. Indemnities and limitation of liability

11.1. Purchasers absolve Roche Diabetes Care, its advertising agencies, advisers, and suppliers from liability for all claims, loss or damages howsoever arising from willful misconduct or negligent acts or omission on the part of any such person.

11.2. Registration to the NOD Educational Course and subsequent use of the chat platform is at OWN RISK and Purchasers hereby indemnify and hold harmless Roche Diabetes Care, its employees, agents, organisers of this service, advertising agencies, advisers and any other related parties, against all claims, losses and liability whether direct or indirect incurred by any participant arising from or in connection with this service, including without limitation, personal injuries, death and property damage and claims based on publicity rights, defamation or invasion of privacy, howsoever arising.

11.3. Roche Diabetes Care shall not be responsible for any misrepresentation caused due to an unintentional copying error, typing error or an error by omission that may occur on any of our promotional material.

12. Disclaimers

12.1. Purchasers are not required to purchase any Accu-Chek blood glucose monitoring systems, devices or software systems to register for the NOD Educational course. Nothing in these Terms and Conditions, or in any advertising collateral in relation to this service shall be read as obliging or requiring any Purchaser to have or be in possession of any Accu-Chek blood glucose monitoring systems for purposes of this NOD Educational course.

13. Utilising the NOD Educational platform

13.1. The NOD Educational course/s is hosted and managed by a 3rd party contracted by the Organiser.

13.2. The content of the NOD Educational course/s has been developed and are owned by the Organiser. Distribution thereof is prohibited.

13.3. Utilisation and access to the NOD Educational platform is assigned to the Purchaser only and solely for the purpose and duration of the NOD Educational course registered for.

13.4. For purposes of this paragraph 13, the following terms shall have the following meaning:

13.4.1. Misrepresentation includes (without limitation) –

13.4.1.1. Providing false, incomplete or inaccurate information when
registering for the NOD Educational course;

13.4.1.2. actions designed to deceive, mislead, defraud or otherwise
make misrepresentations to any person regarding any fact or
circumstance;

13.4.1.3. altering the content of communications received by you and thereafter forwarding same to others without indicating the
nature of the alterations; and

13.4.2. System Abuse means any conduct which does or may –

13.4.2.1. damage, impair, overburden or disable any system of any
person (including us) using any of the purchase and/or NOD
Educational platform made available for this service;

13.5. You agree that, when you use the NOD Educational platform, you will not –

13.5.1. do anything which violates any of our Terms and Conditions;

13.5.2. make any Misrepresentation;

13.5.3. post, upload or transmit any Abusive Content;

13.5.4. do anything that does not comply with generally accepted internet etiquette including (without limitation) the excessive use of capitalised text, the use of inflammatory or antagonistic criticism (“flaming”), or wastefully and unnecessarily including previous communications in any postings;

13.5.5. violate or infringe the intellectual property rights, contractual or fiduciary rights, privacy, personality or publicity rights of another.

13.5.6. perform System Abuse;

13.5.7. repeatedly post gratuitous off-the-topic communications;

13.5.8. transmit Content that you do not own or do not have the right to publish or distribute, whether under law or contract;

13.5.9. perform or encourage any illegal activities including (without limitation) promoting or facilitating access to, use of or sale of dangerous substances or devices;

13.5.10. fail to comply with applicable domestic, national or international laws, rules and regulations;

13.6. Should we consider you to be in breach of any of the Terms and Conditions, then we may, without prejudice to any other rights which we may have under the terms or in law, –

13.6.1. give you a warning;

13.6.2. co-operate with competent law enforcement authorities to the extent reasonably required to do so;

13.6.3. institute appropriate legal proceedings; and/or

13.6.4. comply with such obligations as may be imposed on us by law.
